Filed in: Nascar by admin on 12-08-09

Could NASCAR be sued by Toyota for telling them they can’t buy an existing team?

I think they can since most of tracks are corporations and receive federal aid Toyota can try a restraint of trade suit. And even private companies cannot change rules it has established to keep someone out. Example is NFL which tries but has failed in law suits when a team moves after NFL said they could not (ie Cleveland to Baltimore )
And if you get Toyota mad and they leave who’s left not dodge, not ford and in near future I doubt GM

Could Nazicar buy out Toyota and not allow them to field cars yes.
But it would be a horrible business decision. All American auto companies are in very serious trouble because of their ridiculous union pensions and such. Nazicar should thank God himself that at least one of their makes is financially stable!
Need proof look at the truck series! Without Toyota that series would not exist!

NASCAR is a privately held COMPANY. It does not trade stock, has no “investors” and can change the rules as they go.
(we all know that).
Unless they have a deal in writing, signed and sealed, that NASCAR decides to back out of they can’t sue for not letting them into the series.
They COULD SUE, but it would probably be worthless and wind up just costing us the fans in the end.

Nope. It’s all a matter of business contracts made on behalf of NASCAR. They run the show. They can make the contracts to run their business anyway they want. Legally. Cars dont have rights like people. It’s “business”. Period.

NASCAR is a privately owned organization and can do whatever they want.It is not a Franchise like some people believe or accuse it of being. They can’t tell Toyota and GEM that they can’t be partners, but they can stop letting GEM compete.

Why would NASCAR do that? Maybe NASCAR will end up all Toyota. Looks like Dodge will be gone shortly, Ford already has informed the Ford teams financial support as well as factory support will be reduced drastically.
This is a real possibility.

Apparently Nascar can do whatever it wants. It cancelled a deal for Gillett Evernham Motorsports to switch to Toyota. Something smells pretty bad with everything going on between Toyota and Nascar.

I dont think they can but perhaps they are concerned one of the manufactures may leave (likely Dodge) if one of the premier teams swithces to another maufacture

Absolutely. It’s there series. It’s a privilege to race in NASCAR not a right.

I don’t think so, because NASCAR is privately owned by the France family who do whatever they wish in their empire.
